INDICACIONES PARA LOS AUTORES

La Revista de Derecho Privado, publicación de carácter semestral, recoge los resultados de los trabajos de investigación de profesores y juristas nacionales y extranjeros que sean de interés para la comunidad jurídica. La Revista aborda los temas del derecho privado, prestando especial atención a su desarrollo dentro del ámbito de la tradición romanista, para hacer evidentes los contrastes y las similitudes entre el sistema jurídico latinoamericano y el sistema jurídico europeo, sin descuidar, claro está, la confrontación, que hoy se hace obligatoria, con los sistemas del llamado derecho angloamericano.

La Revista tiene el propósito de alimentar el debate dentro de la ciencia jurídica y propiciar el diálogo entre las fuentes del derecho; por su empeño de afrontar los temas desde la perspectiva del derecho comparado, la Revista tiene proyección internacional y es también su propósito entablar el debate jurídico con estudiosos pertenecientes a otros ordenamientos.

La Revista, puesta al servicio de la comunidad científica y académica en general (docentes, investigadores y estudiantes), y de los miembros del foro (abogados, jueces, servidores públicos y profesionales del derecho), está dirigida a todos aquellos juristas que, desde la teoría o la práctica, buscan profundizar en el conocimiento del derecho privado, con una visión que parte de las bases romanistas del mismo y llega a la identificación de un sistema propio latinoamericano que puede ser confrontado con el sistema europeo e incluso con el derecho de tradición anglosajona.

Dentro del espíritu de apertura que la anima, la Revista recibe todo tipo de trabajos, dando preferencia a los documentos inéditos. En lo que hace a su ideología u orientación, el único requisito es estar científicamente fundados y representar un aporte para ese debate que se quiere alimentar.

PROCESO DE EVALUACIÓN POR PARES

Para garantizar la relevancia científica, la evaluación de los artículos y escritos postulados es realizada por dos árbitros anónimos externos, utilizando la modalidad de doble ciego, lo que garantiza el anonimato de la evaluación. Los pares evaluadores no tendrán conflicto de intereses alguno frente a los autores y sus trabajos. Los evaluadores deben manifestar el conocimiento de los estándares internacionales de publicación científica con los que se compromete la Revista, en particular los referentes al manejo del plagio y el proceso de revisión de pares externos, y aceptar la declaración de confidencialidad. Cuando se presenten casos de controversia en los resultados de las evaluaciones, el Comité Editorial seleccionará un tercer árbitro para tomar la decisión final.

Todos los manuscritos enviados a la Revista se revisan siguiendo el siguiente procedimiento:

Revisión preliminar: el Comité Editorial evalúa cada contribución para determinar la pertinencia en relación con la temática de la Revista, y realiza una evaluación preliminar de la calidad del texto y sobre el respeto de los criterios editoriales. Los manuscritos que no cumplan con los criterios mínimos son devueltos a los autores en un periodo no mayor a un mes a partir de la recepción.

Revisión por pares: los manuscritos que pasan la revisión inicial se envían a dos árbitros anónimos. Estos evalúan la relevancia científica, la originalidad del trabajo, la calidad del texto y de la argumentación, el rigor metodológico, el uso de fuentes originales y actualizadas. A los árbitros se les pide completar sus evaluaciones en un plazo máximo de un mes, y las evaluaciones no se solicitan de forma contemporánea.

Por ello, el proceso de evaluación del comité editorial y de los pares puede tardar como mínimo tres meses. Una vez conocido el resultado de la evaluación se ponen de presente al autor las observaciones remitidas. Luego de atendidas las observaciones de los árbitros, si para el autor son pertinentes, el Comité Editorial emite su concepto final.

Los artículos pueden ser rechazados en cualquier etapa del proceso editorial, en caso de que se detecten serios problemas de estilo, redacción y gramática; así como si se evidencia plagio.

El idioma de la publicación es el español, pero se incluyen traducciones de otros idiomas. De manera excepcional, el Comité Editorial considera la publicación de textos en inglés y portugués.

La presentación y publicación de artículos no genera costos para los autores. La Revista está comprometida con los estándares internacionales de publicación científica. La Revista requiere que los autores autoricen, por medio de una licencia de uso, la edición, publicación, reproducción, distribución y comunicación pública de la obra de su autoría, tanto en soporte físico como digital, para fines exclusivamente científicos, culturales, de difusión y sin ánimo de lucro. Los autores conservan los derechos de autor y garantizan a la Revista el derecho de realizar la primera publicación del trabajo, licenciado con el Creative Commons Atribución – NoComercial-CompartirIgual. La reproducción de los documentos en otros medios impresos y/o electrónicos debe incluir un reconocimiento de la autoría del trabajo y de su publicación inicial, tal como lo estipula la licencia. Los autores podrán divulgar su documento en cualquier repositorio o sitio web. Inmediatamente después de su publicación, los artículos son enviados en medio magnético a las diferentes bases de datos y sistemas de indexación para la divulgación de su contenido. CRITERIOS PARA LA REDACCIÓN Y PRESENTACIÓN DE ARTÍCULOS Y OTRAS COLABORACIONES

Toda colaboración debe ser enviada en un archivo Word (.doc, .docx) a la dirección electrónica de la Revista: [revderprivado@uexternado.edu.co].

Al remitir su contribución, el autor debe manifestar con claridad en el mensaje de correo electrónico:

i) La información biográfica del autor o autores: número de identificación, último título académico ya obtenido, afiliación institucional, ciudad, país y correo electrónico de contacto, número ORCID (si no lo tiene, ingrese a: [https://orcid.org/] y cree su perfil);

ii) Si se quiere precisar que el artículo es producto de un determinado proyecto de investigación, la información correspondiente;

iii) Que está de acuerdo con la Política Editorial de la Revista;

iv) Que su artículo es inédito, y

v) Que el artículo no se encuentra en proceso de evaluación en otra revista u órgano editorial.

I. LAS COLABORACIONES PUEDEN SER:

– Artículos de investigación, que no deben tener una extensión superior a quince mil (15.000) palabras, incluidas las notas y la bibliografía, que ha de contar con al menos quince referencias.

– Comentarios de legislación o jurisprudencia. Las notas a novedades legislativas o jurisprudenciales, nacionales o extranjeras, de interés no deben superar las siete mil (7.000) palabras, incluidas las notas y la bibliografía.

– Reseñas de novedades bibliográficas, nacionales o extranjeras. Las reseñas deben llevar un título y tener una extensión máxima de mil quinientas (1.500) palabras. En la reseña se debe identificar plenamente la obra que se está comentando.

– Documentos de interés. Como leyes o proyectos de ley, nacionales o extranjeros, resoluciones de organismos internacionales o similares que merezcan la atención de la comunidad científica pueden ser señalados a la Revista para su publicación integral. El nombre de la persona que haga la señalación no acompaña al documento en caso de ser publicado.

– Otros escritos. Como páginas in memoriam, páginas escogidas, noticias de actualidad jurídica, información sobre seminarios y cursos, etc., pueden ser publicados por decisión del Comité Editorial.

II. CRITERIOS DE REDACCIÓN

Toda colaboración presentada a la Revista debe respetar los siguientes criterios, so pena de exclusión del proceso de evaluación.

El documento debe elaborarse en Microsoft Word, tamaño carta, márgenes de 2 cm todos los lados, espacio 1.5, tipo de letra Arial, tamaño 12.

Los autores deben asegurar su anonimato de cara al proceso de arbitraje. Para ello es necesario eliminar el nombre de los autores tanto en el artículo como en las propiedades del archivo. Igualmente se sugiere evitar expresiones que permitan deducir la identidad de los autores, cuando se citen publicaciones suyas previas, como “permítasenos el reenvío a…” o “en un trabajo anterior dijimos…”.

Los artículos deben observar la siguiente estructura:

a. Título en español

b. Resumen de no más de cien palabras en español

c. Palabras clave (mínimo 3, máximo 10) en español

d. Título en inglés

e. Abstract

f. Keywords

g. Sumario. Para la numeración de los títulos se debe respetar la siguiente estructura: títulos de primer nivel con números romanos (I., II., III.); títulos de segundo nivel con letras mayúsculas (A., B., C.); títulos de tercer nivel con números arábigos (1., 2., 3.)

h. El texto del artículo. En la introducción se deben exponer con claridad la metodología de investigación y los objetivos, y al final se deben presentar las conclusiones

i. La lista de referencias debe ser organizada en orden alfabético

Los textos presentados en otro idioma deben incluir el título, el resumen y las palabras clave en el idioma respectivo, en español y en inglés.

Toda tabla, cuadro y figura debe llevar un título y estar numerado con números arábigos. Adicionalmente, deben presentarse como parte del texto en un formato que sea posible editar, sin colores de fondo, ni de texto. Para destacar el texto se puede usar cursiva, negrita o mayúsculas.

III. CRITERIOS DE CITACIÓN DE REFERENCIAS

Para elaborar las notas a pie de página y las referencias bibliográficas se sigue una adaptación de la norma ISO 690:2010.

Las citas textuales cortas se hacen entre comillas y sin necesidad de usar la letra cursiva o sangría.

Las citas textuales extensas se separan del texto, con sangría izquierda y sin necesidad de usar comillas.

Toda palabra o frase en idioma diferente del español debe escribirse en caracteres cursivos, caracteres que también se pueden usar para destacar o hacer algún énfasis.

Las referencias bibliográficas deben ir en notas al pie de cada página y al final del texto; el nombre del autor de la obra referida va en letra versales y de él se indica todo el apellido y la inicial del nombre o nombres; luego, seguido de coma, el título del libro en cursivas, sin importar si se trata o no de un libro en español; a continuación se indica si se trata de una edición diferente de la primera; luego el lugar de publicación; enseguida el nombre de la editorial; luego, el año de edición; por último, el número de la página o páginas que se están citando, sin necesidad de usar la abreviación “pág.” o “p.”:

Para los artículos y contribuciones en obras colectivas se siguen las mismas reglas, pero el título debe estar entre comillas y en letra redonda. La obra colectiva se identifica siguiendo las mismas reglas de la citación de libros, con la indicación del editor o coordinador, y las páginas de la contribución consultada. Para los artículos debe identificarse la revista con el nombre completo, sin abreviaciones y en cursiva, la editorial, el volumen, el número y el año de publicación, datos a los que sigue el rango de páginas:

En el caso de obras consultadas en línea, debe también incluirse al final la información de la página web y la última fecha de consulta.

Por último, para la citación de documentos legales se ha de incluir toda la información necesaria y usual para permitir la completa identificación del documento. En el caso de las sentencias judiciales, como mínimo se debe indicar la entidad o corporación que la emite, el número de radicación y la fecha.

En caso de duda sobre cómo citar una obra, se recomienda consultar directamente con el equipo de la Revista.

GUIDELINES FOR SUBMITTING ORIGINALS

The Revista de Derecho Privado is a semi-annual publication that compiles the results of the investigative efforts, researches and articles written by professors and jurists from national and foreign universities, that are of interest to the legal community. The Journal touches on subjects of private law, with special consideration to its development within the traditional roman domain, in order to make evident the contrasts and similarities between the Latin American and European legal systems, without overlooking, of course, the required confrontation, which today is a must, with the so-called the Anglo-American law.

The purpose of the Journal is to encourage debates within the legal science and promote dialog among legal sources; due to its determination to address issues from a comparative law perspective, the Journal has international applications also with the objective to promote debates among scholars of diverse fields.

The Journal, available to the scientific and academic community (teachers, researchers and students) and members of the legal practice (lawyers, judges, public servants, and legal professions in general), is addressed to all legal professionals who, either from the point of view of theory or practice, seek to deepen their knowledge of Private Law, starting from its romanist foundations and arriving to the identification of an own Latin American system which can be compared with the European system and even with the common law systems.

The Journal, in the openness sprit it encourages, will accept all types of works pertaining to its ideology and orientation, with the only requisite that they be scientifically sound and represent a contribution to the debate it seeks to promote.

PEER REVIEW PROCESS

In order to guarantee the scientific relevance of the texts, all articles will undergo rigorous evaluation process prior to publication. The evaluation, which above all is a feedback and constructive criticism process, will be performed by two anonymous referees from outstanding relevant academic fields. The referees will not have conflict of interest with the authors and their works. They should acknowledge the understanding of the journal’s international standards of scientific publication, especially regarding the control of plagiarism and the process of peer review, and accept the privacy statement. The Journal will advise the author of their decision and examiners’ comments and will maintain confidentiality of the evaluations.

All the manuscripts sent to the Revista de Derecho Privado are reviewed following this procedure:

Preliminary review: The editorial committee evaluates each contribution to determine if the topic and content are pertinent in relation to the subject of the journal. The committee evaluates the quality of the text; and the respect of the criteria for the presentation of articles. Papers without the essential requirements are returned to the authors within a period of no more than one month after receipt.

Peer review: Manuscripts that pass the initial review are sent to two anonymous referees. These evaluate the scientific relevance, the originality of the work, the quality of the text and the argumentation, the methodological rigor, the use of original and updated sources. The referees are asked to complete their evaluations in a maximum of one month, and the evaluations are not requested contemporaneously.

This process will take 3 months at least. In case of conflict between two reviews, the Editorial Committee will appoint a third referee to make the final decision. Once the suggested corrections are completed, the Editorial Committee will render its final decision as to publication of the article.

Articles can be rejected at any stage of the editorial process as much by serious problems of style, writing and grammar as by plagiarism.

The Journal is published in Spanish; however, it includes translations from other languages. In exceptional circumstances, works in English and Portuguese may be considered for publication.

Articles must be unpublished. However, it is possible to publish contributions which have previously been edited, but that due to their scientific significance, accessibility, innovation level or relevance to current affairs have special applications in the Colombian legal system.

There are no author processing charges or submission charges for publishing in this Journal. Also, the Journal is committed to international standards of scientific publication. It follows the guidelines of the 2^nd World Conference on Research Integrity, Singapore, July 22-24, 2010:

The Journal requires the author’s approval, through a license of use, for editing, publication, reproduction, distribution and public communication of its work; in physical and digital format, for exclusively scientific, cultural and non-profit purposes. CRITERIA FOR WRITING AND SUBMISSION OF ARTICLES

Each article must be submitted in a word document (.doc; .docx) to the following electronic address: [revderprivado@uexternado.edu.co].

When forwarding work on magnetic media, the author must clearly state:

i) The biographical information: ID number, most recent academic degree, institutional affiliation, city, country and email address, ORCID (if you do not have it, please go to: [https://orcid.org/] and create your profile);

ii) The information about the research project to which the article is linked

iii) If agrees with the Editorial Policy of the Journal;

iv) That the article has not ever been published; and

v) That the article is not in the selection process of another academic journal or publication.

I. CONTRIBUTIONS MAY BE:

– Articles must not exceed fifteen thousand (15.000) words, list of references (15 at least) and footnotes included.

– Comments to legislation or case law. Comments on legislative news or legal issues, of both domestic and foreign interest, must be less than seven thousand (7.000) words, list of references and footnotes included.

– Reviews on bibliography news, domestic and foreign. Reviews must have a title and cannot exceed one thousand five hundred (1.500) words. Review must fully identify the work to which it pertains.

– Documents of interest. Such as laws or proposed legislation, both domestic and foreign, resolutions by international organizations or any type of legal document that merits attention from the scientific community, may be pointed out to the Journal for integral publication. If the article is published, the name of the person suggesting the subject matter will not appear.

– Writings. Such as in memoriam, selected pages, current legal news, information on seminars, courses, etc., may be published on approval by the Editorial Board.

II. WRITING CRITERIA

All items submitted to the Journal must be in a Word document, letter, 2 cm on each border, line spacing of 1.5, font Arial 12.

The authors must ensure the anonymity of the paper. This requires removing the author's name both in the article and in the file properties. It is also suggested to avoid expressions that allow to deduce the identity of the author, when cite previous publications of his.

All articles must contain, without any exception:

a. Title in Spanish

b. Abstract in Spanish (max. 100 words)

c. Keywords in Spanish (min. 3, max. 10)

d. Title in English

e. Abstract in English

f. Keywords in English

g. Table of contents. For the numbering of titles, the following structure must be respected: first level titles with Roman numerals (I., II., III.); second level titles with capital letters (A., B., C.); third level titles with Arabic numerals (1., 2., 3.)

h. The text of the article. In the introduction, the research methodology and objectives should be clearly stated; and in the end the conclusions must be presented

i. List of references in alphabetical order.

Texts presented in another language must include the title, abstract and keywords in that language, in Spanish and English.
Every table and figure must have a title and be numbered with Arabic numerals. Additionally, they must be presented as part of the text in a format that can be edited, without background or text colors. To highlight the text you can use italics, bold or uppercase.

III. CRITERIA FOR CITATION OF REFERENCES

Rules for footnotes and bibliographic references must follow the guidelines outlined in the International Standard ISO 690: 2010.

Short text quotes made within the document will be in quotation marks, without italic or any type of indentation. Long textual quotes should be in a separate paragraph, without quotation marks and with left indentation. Any work or phrase written in a language other than Spanish shall be shown in italic characters, which may also be used to highlight a word or phrase that needs to be emphasized.

References must be on footnotes, and at the end of the text: the author’s name will be in capital (versal) letters, displaying full last name and the initials of the first name or names; then, followed by a coma, the book title in italic, whether the book is written in Spanish or any other language; then indicate if it pertains to a particular edition; following specify place of publication; followed by the name of the editorial, year of publication; and lastly, the page or pages number of the quotes referenced (only in footnotes), without the abbreviation “pp” or “p”.

For articles and contributions to collective works the same rules will continue, but its title must be in quotes. The reference of a collective work must indicate the editor or coordinator, and the range of pages of the individual contribution. For articles, the name of the journal should be shown in italics, with the information about publisher, year of publication and the range of pages.

For documents online, it should also be included the information of the website and the last date of consultation, at the end of the reference.

For legal documents, it is necessary to include all the useful information to identify the document, at least: reference number, organism, date.
